Terms and Conditions

It is illegal to sell alcohol to people under the age of 18. By placing an order, you must confirm that you are 18 years old or above. You must ensure that no other person except yourself shall use your login to purchase alcohol products and a person aged 18 or above (identification required) must be present to take delivery, otherwise delivery shall be withdrawn and attempted at another time to be agreed between you and us.

1. General

1.1. In these terms and conditions, "Wine Guru" or "we" or "us" means Wine Guru Company Limited, a limited company registered in Hong Kong; and the "customer" or "you" means any person, firm, company or body which places an order with us. Please read these terms and conditions carefully before using this website. By using the site or any part of it, you agree that you have read these terms and conditions and that you accept and agree to be bound by them.

1.2. We shall make every effort to ensure that prices, details and sizes of products on our website are up-to-date. Prices are subject to change without prior notice and all orders are subject to our acceptance at our sole discretion and stock availability.

1.3. We shall make every effort to ensure product(s) displayed on our website are in stock. If from time to time any products become out of stock, we reserve the right to offer alternative product(s) of similar value and style.

1.4. All orders are subject to confirmation of final availability and we reserve the right to reject the order in the event that any of the products or services requested are unavailable.

 

2. Registration

2.1.You are required to register as a user before placing any order through our website. During the registration:

• You must provide us with accurate, complete and up to date registration information;

• You must safeguard your username and password;

• You authorise us to assume that any person using the e-store with your username and password is either you or is authorized to act for you;

• We have the absolute discretion to refuse registration of a potential customer and to terminate the registration of any customer for any reason whatsoever.

2.2.Please inform us via our website/by email/by phone immediately of any changes to the information that you provided so that we can communicate with you effectively.

 

3. Privacy Protection

We are committed to comply with the requirements of the Hong Kong Personal Data (Privacy) Ordinance (PDPO).

We may collect and hold personal data as per your permission. 

3.1 The information you provide in the “Contact us” section, the “Register” or other similar function on this website is used by us to respond to or handle your enquiries or other matters. The personal data will not be used for any other purposes, disclosed or transferred without your consent, unless such use, disclosure or transfer is permitted or required by law.

3.2 Personal data collected from subscribers is used by us to inform you and to send you information as per your requests. The personal data will not be used for any other purposes, disclosed or transferred without your consent unless such use, disclosure or transfer is permitted or required by law.

 

3.3 Different retention periods apply to the various kinds of personal data collected and held by the company.

(a) Personal data provided under the “Contact us” section will be deleted 90 days after any required action has been completed.

(b) Personal data provided for the subscription / registration service will be deleted 90 days after you unsubscribe from our services.

(c) Personal data provided for complaint purposes is retained for such period as may be necessary for the proper handling of the complaint and to satisfy the regulatory requirements.

Under the Hong Kong Personal Data (Privacy) Ordinance, individuals have the right to request access to and correction of their personal data. If you wish to access, correct or delete your personal information held by the company, please send your enquiry or request marked “Personal information enquiry” by post or by email. When handling a data access or correction request, we will check the identity of the requestor.

4. Payment

 

4.1. Our website accepts payment methods that are listed in the “Payment” section. All product prices listed are in Hong Kong dollars. 

 

4.2 Payment is due at the time of order. We reserve the right to cancel orders if we have not received payment within 7 days of the due date.

 

4.3. Acceptance of orders is subject to our sole discretion. A final invoice will be issued to you when goods are delivered to your address.

4.4. We do not accept any return of goods nor will provide any refund for any confirmed orders.

 

5. Warranty Disclaimer and Limitation of Liability

 

5.1 In no circumstances shall Wine Guru’s liability to the customer for any breach of warranty exceed the price paid for the Goods in respect of which the claim is made.

 

5.2 Except as provided for in these terms and conditions there are no warranties, express or implied, of fitness for a particular purpose or of any other kind except as to title. In particular, all terms and warranties which would otherwise be implied by statute or under common law are hereby excluded to the fullest extent permitted by law.

 

6. Others

 

6.1. Force majeure: We shall not be liable for any delay or failure to perform caused by or resulting from acts of God, fire, flood, accident, riot, war, government intervention, embargoes, strikes, labour difficulties, equipment failures, or any other causes beyond our control.

6.2 Customer is requested to examine the goods immediately upon delivery for any deficiencies and/or damages. Claims for the reason of damages (if any) must be communicated immediately to us with proof. Any claim is subject to our sole discretion. 

 

6.3. If any provision of these Terms and Conditions shall be construed to be illegal or invalid, they shall be removed from these terms and it shall not affect the legality, validity and enforceability of the other provisions of these Terms and Conditions.

  

6.4. If any dispute arises, our determination shall be final. Where these Terms and Conditions are available in Chinese, the English version is the governing version and shall prevail whenever there is a discrepancy between the two versions.

 

6.5. These Terms and Conditions shall be governed by the laws of the Hong Kong Special Administrative Region, the People's Republic of China and the Customer and we agree to submit to the exclusive jurisdiction of the Hong Kong courts. We may revise the Terms and Conditions at any time without prior notice.
